EAST GREENBUSH - The Zoning Board of Appeals listened to more than one hour of public comment Tuesday regarding the area around Thompson Hill being proposed for a Planned Development District as part of the Capital View Casino & Resort.
The hearing and decision has been tabled until Oct. 14.
“We are pleased the process is moving forward and are excited to have the opportunity to bring jobs and millions in new revenue to East Greenbush and the Capital Region,” said Morgan Hook, spokesperson for Capital View Casino & Resort.
The ZBA will look at the legal interpretation of allowing the proposed casino in a residential buffer area.
Save East Greenbush’s attorney Jeff Meyer said that the amenities offered by the Capital View casino are prohibited under the zoning. Along with this, he felt that re-writing the zoning law would have far reaching effects.
“The zoning only allows residential use in residential buffer areas and the casino is not residential,” said Meyer, noting that the lawsuit regarding the town board’s decision is still ongoing as well.
Those interested in giving a comment can still do so in writing by Sept. 30.
