Repeat Drunk Driver Sentenced for Striking Parked Car While Intoxicated

District Attorney P. David Soares announced that NELSON RUBIO, 24, of Troy, was sentenced to 1 ½ to 4 ½ years before the Honorable Stephen W. Herrick in Albany County Court this morning.

On August 21, 2014, RUBIO pleaded guilty to (1) Count of Driving While Intoxicated, a Class D Felony.

On June 21, 2014, at approximately 4:03am, an Albany Police Officer did observe a Gray 2006 Hyundai crash into a parked car near the intersection of James Street and Columbia Street in the City of Albany. RUBIO fled the scene but officers did pursue and were able to stop him several blocks away. Police determined that RUBIO was operating the vehicle and detected the odor of alcoholic beverage coming from the vehicle. RUBIO failed every sobriety test that police conducted, displayed watery eyes and slurred speech, and admitted to drinking alcohol before driving the vehicle. RUBIO refused to submit to a chemical breath test.



At the time of the crash RUBIO’s driver’s license was suspended for a 2011 DWI conviction. RUBIO also has a 2010 DWI conviction from a neighboring county.  

Assistant District Attorney David Szalda of the Vehicular Crimes Unit prosecuted this case.

  1. Repeat drunk driving incidents are going to be difficult for Mr Rubio. DUI arrest can be frustrating, but one have to be cooperative throughout the process.
